Terms of Service

1. Eligibility

You must be of legal drinking age in your jurisdiction to use the App. By creating an account, you confirm that you meet this requirement. We reserve the right to terminate accounts if we have reason to believe a user does not meet the age requirement.

You must be at least 17 years old to download the App, as required by Apple's App Store guidelines.

2. Account Registration

To use the App, you must create an account using Apple Sign-In, Google Sign-In, or email/password. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activity that occurs under your account

You may not create accounts for other people, use another person's account, or transfer your account to anyone else without our permission.

3. Description of the App

Roam is a social application designed for group nights out. The App provides the following features:

• Roam Sessions — Create or join private group sessions with friends using invite codes
• Real-Time Map — View the locations of session members who have opted to share their location
• Drink Logging — Log drinks manually or using AI-powered camera recognition
• BAC Estimation — Receive estimated Blood Alcohol Content based on your drink history, weight, and biological sex
• Social Feed — Share photos, videos, and captions privately within your Roam session
• Location & BAC Sharing — Optionally share your real-time location and BAC with session members

4. BAC Estimates — Important Disclaimer

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

The App provides BAC (Blood Alcohol Content) estimates using a mathematical model (the Widmark formula) with conservative assumptions and a built-in safety bias. These estimates are provided for informational and awareness purposes only.

BAC estimates provided by the App:

• Are NOT medical advice
• Are NOT a substitute for a breathalyser, blood test, or professional assessment
• Are NOT accurate for all individuals — actual BAC varies significantly based on food intake, hydration, medication, metabolism, liver function, fatigue, individual physiology, and many other factors not captured by the model
• Should NEVER be used to determine whether you are fit to drive, operate machinery, or engage in any activity requiring sobriety
• May underestimate or overestimate your actual BAC

YOU ACKNOWLEDGE AND AGREE THAT:

• You will not rely on BAC estimates from the App to make decisions about driving or operating vehicles or machinery
• You are solely responsible for your own safety and the safety of others
• You will arrange safe transportation (taxi, rideshare, designated driver, public transport) if you have consumed any alcohol
• We are not liable for any injury, death, legal consequences, or damages arising from reliance on BAC estimates provided by the App

If in doubt, do not drive. Always err on the side of caution.

5. Acceptable Use

You agree to use the App lawfully and responsibly. You must not:

5.1 Prohibited Conduct

• Use the App for any unlawful purpose
• Use BAC estimates to justify driving or operating machinery while impaired
• Share or distribute another user's location, BAC, photos, or personal information outside of the App without their explicit consent
• Post content that is illegal, abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable
• Post content depicting or encouraging illegal activity
• Impersonate any person or entity
• Attempt to gain unauthorised access to other users' accounts or data
• Interfere with or disrupt the App or its servers
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to stalk, harass, or monitor another person without their consent
• Use automated systems, bots, or scripts to access the App
• Exploit the invite code system to join sessions without genuine invitation
• Upload malware, viruses, or other harmful code

5.2 Content Standards

All content you post (photos, videos, captions, comments) must:

• Be your own original content or content you have permission to share
• Not infringe any third party's intellectual property, privacy, or other rights
• Not contain personally identifiable information of others without their consent
• Comply with all applicable laws and regulations

We reserve the right to remove content that violates these standards without notice.

6. User Content

6.1 Ownership

You retain ownership of all content you create and upload to the App (photos, videos, captions, comments). We do not claim ownership of your content.

6.2 Licence Grant

By posting content to the App, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, transmit, and display your content solely for the purpose of operating and providing the App's features (such as displaying your posts to session members). This licence terminates when you delete your content or your account.

6.3 Visibility

Content posted to a Roam session feed is visible only to members of that session. We do not make your content publicly available. However, we cannot control what other session members do with content they can see (such as taking screenshots). You are responsible for exercising judgement about what you share.

6.4 AI Processing

When you use the AI drink recognition feature, your drink photo is transmitted to Google's Gemini AI service for processing. By using this feature, you consent to this transmission. You may always log drinks manually instead.

7. Location & BAC Sharing

7.1 Opt-In Controls

Location sharing and BAC sharing are controlled by toggles within the App. When enabled, your real-time location and/or BAC estimate are visible to other members of your active Roam session.

7.2 Your Responsibility

You are responsible for managing your sharing preferences. We are not liable for any consequences arising from your decision to share your location or BAC with session members. You acknowledge that other session members may act on the information you share.

7.3 Background Location

If you grant “Always” location permission, the App may continue to update your location with session members while running in the background. You can revoke this permission at any time through your device settings.

8. Roam Sessions

8.1 Session Creation & Membership

Sessions are created by a user and joined by others via a 6-character invite code. The session creator can remove members and end the session. Sessions automatically expire after the duration selected by the creator (up to 24 hours).

8.2 Session Privacy

Sessions are private to their members. Only users who join a session via the invite code can see session content, member locations, and BAC data. You are responsible for sharing invite codes only with people you trust.

8.3 Session Content

Content shared during a session (posts, photos, videos) is accessible to all session members. We do not monitor session content in real time but reserve the right to investigate and take action on reported violations of these Terms.

9. Intellectual Property

9.1 Our Rights

The App, including its design, features, code, graphics, logos, and trademarks, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

9.2 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use them without restriction or compensation.

10. Third-Party Services

The App relies on third-party services including Supabase, Google/Firebase AI, Google Sign-In, and Apple Sign-In. Your use of these services is subject to their respective terms:

We are not responsible for the availability, accuracy, or practices of third-party services. If a third-party service experiences downtime or changes its terms, certain App features may be temporarily or permanently affected.

11. Account Termination

11.1 By You

You may delete your account at any time through the App's settings. Upon deletion, your profile, drink logs, sessions you created, feed content, and authentication record will be permanently deleted.

11.2 By Us

We may suspend or terminate your account at any time, with or without notice, if:

• You violate these Terms
• We reasonably believe your conduct poses a risk to other users or to us
• We are required to do so by law
• We discontinue the App

11.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including Sections 4 (BAC Disclaimer), 12 (Limitation of Liability), 13 (Indemnification), and 15 (Governing Law).

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, error-free, or secure
• BAC estimates will be accurate for any individual
• Location data will be accurate or up to date
• AI drink recognition will correctly identify all drinks
• Data will not be lost or corrupted

IN NO EVENT SHALL WE BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages arising from your reliance on BAC estimates
• Any damages arising from your decision to drive or operate machinery
• Any injury, death, or property damage arising from use of the App
• Any actions taken by other session members based on shared data
• Any unauthorised access to or alteration of your data
• Any third-party service failures or data breaches

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR AUD $50, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Roam, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third party's rights
• Your reliance on BAC estimates provided by the App
• Content you post or share through the App
• Your decision to drive or operate machinery after consuming alcohol

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal claim, you agree to contact us at legal@tryroamapp.com and attempt to resolve the dispute informally for at least 30 days.

14.2 Governing Law

These Terms are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.

14.3 Jurisdiction

Any disputes arising from these Terms or your use of the App that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Australia.

15. Alcohol Responsibility

The App is designed to promote awareness and safety during social drinking. It is not designed to encourage, facilitate, or enable excessive alcohol consumption.

You acknowledge that:

• You are solely responsible for your alcohol consumption and behaviour
• The App does not encourage you to drink more or continue drinking
• Alcohol affects individuals differently and can impair judgement, coordination, and reaction time
• You should always drink responsibly and within your personal limits
• You should always arrange safe transportation before drinking
• You should seek medical attention if you or someone else shows signs of alcohol poisoning

If you or someone you know is struggling with alcohol, please contact your local support service.

16. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will:

• Update the “Last Updated” date at the top
• Notify you through the App for significant changes

Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the App and delete your account.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Roam regarding your use of the App, and supersede any prior agreements.
